These Terms of Service govern your use of www.paceandphysio.com and communications with Pace & Physio (“Pace & Physio,” “we,” “us,” or “our”).

Informational Website and Coaching

Website content is provided for general informational and educational purposes. It is not medical advice, diagnosis, treatment, or a substitute for individualized care from an appropriate licensed healthcare professional.

Submitting a form, booking a complimentary consultation, sending an email, or using this website does not create a coach-client relationship, a physical-therapy patient relationship, or any other provider-patient relationship.

A paid coaching relationship begins only after Pace & Physio accepts the client, the required agreement and waiver are completed, and applicable payment arrangements are made.

Eligibility

You represent that you are at least 18 years old or, if you are a minor, that a parent or legal guardian has contacted Pace & Physio and provided all required consent.

No Medical or Emergency Services

Do not use this website, email, or coaching communications for urgent or emergency concerns. If you have chest pain, severe shortness of breath, fainting, sudden weakness, significant trauma, severe or worsening pain, or another emergency, call 911 or seek immediate medical care.

Intellectual Property

All website content, training resources, text, graphics, logos, programs, videos, plans, and other materials provided by Pace & Physio are owned by or licensed to Pace & Physio and are protected by applicable law.

You may use materials provided to you only for your personal, noncommercial use. You may not copy, publish, reproduce, distribute, sell, sublicense, modify, or share them without prior written permission.

Acceptable Use

You agree not to use this website in a manner that is unlawful, harmful, fraudulent, disruptive, or intended to interfere with site security or other users’ access.

Third-Party Services

This website may link to or integrate with third-party services, including scheduling, payment, coaching, email, and social-media platforms. Pace & Physio is not responsible for third-party websites, practices, content, availability, or policies.

Disclaimer of Warranties

The website and its content are provided “as is” and “as available.” To the fullest extent permitted by law, Pace & Physio disclaims warranties of any kind, whether express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose, and noninfringement.

Nothing in these Terms replaces the separate coaching agreement, informed consent, and release/waiver that must be signed before paid coaching begins.

These Terms are governed by the laws of the State of Nebraska, without regard to conflict-of-law principles. Venue for disputes, where legally permissible, will be in the appropriate state or federal court located in Nebraska.

Changes

We may modify these Terms at any time. Continued use of the website after updates are posted indicates acceptance of the revised Terms.
